Your use of the Services may also include additional terms and conditions posted on the Website when you use specific Services. If you object to anything in these Terms please do not use the Services or the Website.

Our graphics, logos, page headers, button icons, scripts and service names are protectable under applicable trademark and trade dress laws. Our trademarks and trade dress may not be used in connection with any product or service that is not EM’s, or not authorized by EM in writing, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits EM. All other trademarks not owned by EM or its subsidiaries that appear on this Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by EM or its subsidiaries.

8. Non-Commercial Use of this Website. The Website and Services are for personal use only. You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purpose, any portion or use of, or access to, the Website, its Content or Services. EM also prohibits uses and activities involving its Services that are illegal, infringe the rights of others, or interfere with or diminish the use and enjoyment of the Services by others.

9. Return Policy. EM wants you to be satisfied with our Services. In the event you find EM Services are not right for you, we offer a fifteen (15) day money back guarantee. In order to receive a full refund, you must prove that you have used the Services to the best of your ability and given EM a chance to cure the problem.

To request a refund, you must contact EM, advise of your issue, and provide EM with the following within 15 days of your purchase:

a. Brand Discovery Course.

i. Proof of completed workbook; and

ii. Proof of efforts to brand company (e.g., copies of mood board, style guide, logo variations, font variations, color palette, and the like).

b. Website 101 Course.

i. Proof of completed workbook; and

ii. Proof of efforts to create business website (e.g., screenshots of business website).

c. Mastering Wholesale Course.

i. Proof of completed workbook; and

ii. Proof of efforts to create business collaterals (e.g., copies of line sheets, terms and conditions, look books, order forms, and the like).

d. Public Relations Course.

i. Proof of completed workbook: and

ii. Proof of contacting media, utilizing social media and the like.

Upon receipt and review of proof of your best efforts, completed workbooks and other evidence provided, EM will determine whether you qualify for a refund of your purchase. All refunds are discretionary. Our Services are personal in nature and results may vary.

If you opted for a payment plan for your purchases, and EM determines you are eligible for a refund within the 15 day period, the refund will be for the portion of payments made. If however, you do not qualify for a refund for any reason, by law you are obligated to continue making payments pursuant to agreement. Charge backs will be investigated any if found to be invalid, improper or fraudulent, said charge back(s) will be prosecuted to the fullest extent of the law.

10. No Warranties. ALL SALES ARE FINAL. EM makes no express or implied warranties, of any kind related to this Website or the materials contained on this Website. This Website is provided “AS IS”, “AS AVAILABLE”. Individual results may vary with Services.

11. Limitation of Liability. You expressly agree that in no event, to the fullest extent of the law, shall EM, nor any of its officers, directors and employees, be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including loss of profits arising out of or in any way connected with your use of this Website or Services, whether such liability is under contract, tort or otherwise, and EM, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website or Services.

EM has no control over any Resources that are provided by companies or persons other than EM. You acknowledge and agree that EM is not liable for any loss or damage which may be incurred by you as a result of the availability of those external Resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from such Resources. Please review carefully the third-party’s terms and conditions, privacy or similar policies. Complaints, claims, concerns or questions regarding third-party products or services should be directed to the third-party.

EM utilizes secure third party payment and delivery sources to process payments and fulfill all orders for shipping. Your use of these third party services may be subject to separate policies, terms of use and fees of these third parties. EM is not liable to you for any loss as a result of such use of these third parties.

14. Indemnity. You agree to indemnify and hold EM, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliate, harmless from any demands, loss, liability, claims or expenses (including attorney’s fees), made against EM by any third party due to or arising out of or in connection with your use of the Website or Services.

19. Governing Law & Jurisdiction. These Terms will be governed by and construed in accordance with the laws of the State of Florida, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes.
